This Policy is incorporated into and is subject to the Episona Terms of Service. Capitalized terms used but not defined in this Policy have the meaning given to them in the Episona Terms of Service. Your use of the Test Kit is also subject to the informed consent (“Informed Consent”) you are required to execute prior to activating the Test Kit.
What information do we collect and why?
In general, we use the information that we collect through the Service to operate and enhance features of the Service, to provide services and information that you request, to respond to comments and questions and otherwise to provide support to clients. In addition to the foregoing, the information we collect and the reasons for collecting it include the following:
Personally Identifiable Information. When you use the Service, we may collect what is generally called “personally identifiable” information, or “personal information,” which is information that specifically identifies an individual. Examples of personal information include name, email address, mailing address, phone number, and credit card or other billing information. Personal information also includes other information, such as date of birth, or geographic area when any such information is linked to information that identifies a specific individual. Individuals using the Service may provide us with personal information about themselves and their healthcare providers. Healthcare providers using the Service may provide us with information about their patients and their practices, including NPI numbers, fax numbers, and the name, job title, and contact information of other providers involved in an individual’s care. We may use this information (i) to contact you for administrative communications, such as by sending you an email to confirm that you have ordered the Episona Test, to notify you when your healthcare provider has provided Episona with your information in an order form, or to send a Episona Test Result or (ii) to send promotional communications, including updates on products and events, relating to products and services offered by us and by third parties we work with. You have the ability to opt-out of receiving promotional communications by updating your account settings or by following the unsubscribe instructions in a promotional communication.
Protected Health Information. We may collect protected health information from you or your healthcare provider and use it as provided in the Informed Consent.
Customer Support. We may collect personal information through your communications with our customer-support team and use the information to respond to your inquiry.
“Cookies” Information. To improve and customize your experience with the Service, we may send one or more cookies – small text files containing a string of alphanumeric characters – to your device when you use the Service. We may use both session cookies that disappear after you close your browser and persistent cookies that remain after you close your browser and may be used by the browser on subsequent visits to the Service. Please review your web browser “Help” file to learn how to adjust your cookie settings, however, some Services may not function properly if you disable cookies.
Information About Third-Party Cookies. In addition to the cookies we deliver to your computer or mobile device through this Site, certain third parties may deliver cookies to you for a variety of reasons. Other third parties may deliver cookies to your computer or mobile device for the purpose of tracking your online behaviors over time and across non-affiliated websites and/or delivering targeted advertisements either on this Site or on other websites. Please note that the Add-on does not prevent information from being sent to us.
In addition, if you would like to opt-out of having interest-based information collected by certain entities during your visits to this Site or other websites, please click here. You will be directed to an industry-developed website that contains mechanisms for choosing whether each listed entity may collect and use data for online behavioral advertising purposes. It may be that some of the third parties that collect interest-based information on this Site do not participate in the industry-developed opt-out website, in which case the best way to avoid third-party tracking of your online behaviors may be through your browser settings and deletion of cookies.
“Automatically Collected” Information. When you use the Service, we may automatically record certain information from your device by using various types of technology, including “clear gifs” or “web beacons.” This “automatically collected” information will help us customize and improve your experience with the Service and may include your IP address or other device address or ID, web browser and/or device type, the web pages or sites that you visit just before or just after you use the Service, the pages or other content you view or otherwise interact with on the Service, and the dates and times that you visit, access, or use the Service. We also may use these technologies to collect information regarding your interaction with Episona email messages, such as whether you opened or clicked on a message, to improve the product. We use “automatically collected” information to (i) personalize our services, such as remembering your information so that you will not have to re-enter it during your visit or the next time you visit the Service; (ii) provide customized content and information; or (iii) monitor and analyze the effectiveness of the Service and third-party marketing activities. Episona does not currently alter its collection of “automatically collected” information based on your selection of the “Do Not Track” option provided by your browser.
When we disclose information.
Except as described in this Policy, we will not disclose your information that we collect through the Service to third parties without your consent. We may disclose information to third parties if you consent to us doing so, as well as in the following circumstances:
We may release your protected health information only as set forth in the Informed Consent.
We may work with third party service providers to provide website, application development, analytics, payment processing, hosting, maintenance, support ticketing, and other services for us. These third parties may have access to or process your information as part of providing those services for us. Generally, we limit the information provided to these service providers to that which is reasonably necessary for them to perform their functions, and we require them to agree to maintain the confidentiality of such information.
We may share aggregated non-personally identifiable information, for example aggregated trends about the general use of our Service, publicly and with our partners (which information will not include protected health information).
We may work with third party advertising partners to show ads for our Services that we think may interest you after you visit our Service. These third party partners collect non-personally identifying information from you when you visit our website and other websites. If you do not wish to receive our personalized ads, please visit the opt-out pages of the Network Advertising Initiative or the Digital Advertising Alliance to learn about how you may opt out of receiving personalized ads from member companies.
We may also disclose your information that we believe in good faith is appropriate or necessary to enforce our Terms of Service; address fraud, security, or technical issues; comply with law enforcement requests and legal process, such as a court order or subpoena; or protect against harm to Episona or others to the extent required or permitted by law.
Information about our users, including personal information, may be disclosed and otherwise transferred to an acquirer, or successor or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.
You may, of course, decline to share certain personal information with us, in which case we may not be able to provide to you some of the features and functionality of the Service. If you wish to access or amend any other personal information we hold about you, you may modify your account settings or contact us at firstname.lastname@example.org. Please note that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.
If you receive commercial email from us, you may unsubscribe at any time by following the instructions contained within the email. You may also opt-out from receiving commercial email from us, and any other promotional communications that we may send to you from time to time, by modifying your account settings or sending your request to us by email at email@example.com.
Please be aware that if you opt-out of receiving commercial email from us or otherwise modify the nature or frequency of promotional communications you receive from us, it may take up to ten business days for us to process your request, and you may receive promotional communications from us that you have opted-out from during that period. Additionally, even after you opt-out from receiving commercial messages from us, you will continue to receive administrative messages from us regarding the Service.
Please do not use or access any part of the Service if you are under 13 years of age. If you are a parent or guardian and discover that your child under 13 years of age has obtained an account on the Service, then you may alert us at firstname.lastname@example.org, and we can take action to prevent access. You must be at least 18 years of age to use our Test Kit.
We understand and value your privacy rights, which is why we take care to safeguard your personal information and protected health information. We use certain physical, managerial, and technical safeguards that are designed to improve the integrity and security of your personally identifiable information. We cannot, however, ensure or warrant the security of any information you transmit to us or store on the Service, and you do so at your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
The Service is hosted in the United States and is intended for visitors located within the United States. If you choose to use the Service from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Service.
